These General Terms and Conditions of Sale govern the sale of merchandise by GUNAS Corporation of America, Inc. (“GUNAS” or “we”) to you or through the SHOP section of Gunasthebrand.com (the “Site”). The sale is available only for purchases exclusively within the Continental United States and Alaska, Canada, Japan, Europe and Australia. Your use of the Site to purchase merchandise or otherwise, indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale, our Privacy Policy, which is hereby incorporated by reference, other notices which may be posted on the Site, and all applicable laws and regulations. Please read these General Terms and Conditions of Sale carefully before accessing and using this Site. GUNAS USA INC. holds the right to alter, change, amend these terms at any time.
ORDERS
You can either place your order online through our e-store or by simply emailing us with the product code of the bag you’d like to order. We will follow up with a phone call as soon as possible to process your payment. If you received our mail catalog and wish to place an order, please email us with the product code along with your contact information. All orders are subject to written acceptance by GUNAS. Orders will be confirmed in writing, by e-mail. Once accepted, the order may not be changed or cancelled except as otherwise provided for in this Terms and Conditions or as required by applicable law.
For each product selected on the Gunasthebrand.com website, a summary page will be displayed featuring a photograph of the item, its colors, product code, quantity selected, unit price, and the total amount owed for the order. It is the responsibility of the customer to check that this displayed information accurately reflects their selection before confirming their order.
Upon confirmation, the order will be sent to GUNAS for processing. While every effort will be made to ensure the color, design, and style of the GUNAS products displayed on the Gunasthebrand.com website are representative of the original products, slight variations may occur for technical and other reasons.
Accordingly, GUNAS shall not be liable for any error or inaccuracy in the photographs or graphical representations of GUNAS products displayed on the Gunasthebrand.com website. If the customer has any questions about the products, they may contact the customer service department by emailing sales@gunasthebrand.com.
GUNAS has the right to cancel any order placed by a customer with whom it has had a dispute concerning a prior order, or if GUNAS has reasonable ground to suspect that such customer has violated these Terms and Conditions, or is engaged in fraudulent or grey market activities. GUNAS also has the right to refuse orders exceeding either $5,000 or 5 units.
AVAILABILITY
GUNAS reserves the right to change the assortment of items offered on the Gunasthebrand.com website from time to time without prior notice to the customer.
GUNAS will not be liable if any product is out of stock or otherwise unavailable at the time of placing the order. In the circumstance that any item a customer selects becomes unavailable after confirmation of the order, the customer service unit will inform the customer by phone or e-mail as soon as possible.
The customer will have the option to choose another product or cancel their order, unless the order which was made was a multiple order, in which case the customer service unit will inform the customer by phone or email to communicate which part of the order will ship. The customer will only be charged for the part of the order which is shipped and may then choose another item to replace the unavailable item, which will be processed as a separate order.
If your item is a “special order” please allow 6-8 weeks for delivery. If your item is in stock it will be shipped out within the next 3 business days unless a request is made for quicker means of shipment.
CONFIRMATION OF ORDERS
In order to process the order, the customer must click the ‘complete purchase’ option on their computer. Upon confirmation, the order will be submitted to GUNAS for processing and may not be changed or cancelled except as expressly provided in these terms and conditions or as required by applicable law.
GUNAS records evidence of all transactions between Gunas and its customers. In the event of a dispute between Gunas and one of its customers relating a transaction conducted on the website or via email, the data recorded by Gunas shall be treated as evidence of the details of the transaction.
PRICES AND PAYMENTS
The prices of GUNAS products are indicated in U.S. dollars, excluding taxes and shipping costs.
GUNAS charges state, county and local tax as required by applicable law.
GUNAS reserves the right to modify the price of products offered on the Gunasthebrand.com website at any time without prior notice to the customer. The customer will be charged the prices displayed on the Gunasthebrand.com website at the time the order was confirmed provided that the products are available at that time.
The customer is required to pay for any order placed on the Gunasthebrand.com website immediately upon confirmation. We only accept payment by credit, charge and debit cards. Customers cannot use store credits or gift certificates to purchase items offered on the Gunasthebrand.com website. All orders are payable in U.S. dollars. We accept the following credit, charge and debit cards: American express®, Mastercard ®, Visa ®. The customer’s credit, charge or debit card will only be charged when their order is dispatched. If any of the products in the order are unavailable, GUNAS will only charge the price, taxes and shipping costs for the goods available.
RESERVATION OF TITLE
Products ordered by customers will remain the property of GUNAS until GUNAS has received full payment thereof. If there is any problem with payment, the customer is responsible to return the goods received to GUNAS immediately upon request.
The customer accepts all risk for the goods (including loss, theft, or damage of any order) upon shipment.
SHIPPING COSTS
The customer will be asked to select the shipping method as a part of the ordering procedure.
Delivery costs depend on the value of the order and the delivery service chosen.
Orders will be delivered using UPS or FEDEX. Flat rate shipping charges apply to Domestic ground shipments of $ 14.99 per bag (plus insurance/tax). For Second day and Overnight shipping charges will vary depending on the receiver’s postal code. Flat rate shipping fee of $50.00 per bag is applicable for all International orders (Plus insurance/Domestic taxes). International orders do not qualify for Second day and Overnight shipment.
Ground: the order must reach us by 12:00 noon est. to ship out the same day. It will be delivered within 1 to 7 days from the shipment date.
Second day: the order must reach us by 12:00 noon est. to ship out the same day. It will be delivered within 2 business days from the shipment date.
Overnight: the order must reach us by 12:00 noon est. to ship out the same day. It will be delivered within 1 business day from the shipment date.
CANCELLATION & RETURN POLICY
IN-STOCK Items: In an event that you are not fully satisfied with your purchase simply email us immediately and we’ll issue a complete refund for your purchase (minus shipping cost). All items must reach us within 15 days of receiving. They MUST be in the original condition with tags intact and unused in order to receive a full refund. Any product that has been used or tampered with prior to return and is not in an acceptable condition will not be refunded and will be shipped back to buyer. By purchasing an item on our online store, buyer accepts our return policy automatically. Any unused, brand new item received after the 15 day return period will be charged a 25% restocking fee.
If you change your mind about an order you haven’t yet received cancellations will be accepted unto 2 business days. If the order has already shipped out, refund will be issued only once the product returns to our warehouse.
SPECIAL-ORDER Items: Special order item cancellations will only be accepted up to 5 business days after the order has been placed. Any cancellation requests made after that will be subjected to a 10% cancellation fee unto 15 days. Special order items cannot be returned. All sales are final.
INTELLECTUAL PROPERTY AND TRADEMARKS
All trademarks, logos and service marks (the “trademarks”) which appear on this website are registered and/or unregistered GUNAS trademarks. Nothing contained in the website should be construed as granting by implication or otherwise, any license or right to use any trademark displayed on this website without the written permission of GUNAS.
You have permission to electronically copy and print hard copies of pages from this website solely in connection with non-commercial purposes related to placing an order or shopping with the website. Unless we give you specific permission in advance, any other use of this website, its content and its information, are strictly prohibited.
